A pensioner claims he has lost £40,000 after entering into a legal battle with his neighbour over six-and-a-half inches of garden space.

John Micallef became embroiled in the boundary row after requesting that his neighbour replace a deteriorating fence separating their properties in Hanwell, west London.

What began as a simple request spiralled into a legal battle spanning four years.

Mr Micallef, 71, had signed a settlement agreement that gave the contested ground to his neighbour.

However, he claims he was deceived and the land was taken from him.

The father-of-two explained the problem arose when he noticed various wildlife, including rats, making their way through gaps in the rotting fence.

Mr Micallef told the Daily Mail: “He’s taken six-and-a-half inches on my side. Even a blind man can see this.

“I’ve never caused problems. And to do these things to me for something I never did? How would you feel, £40,000 gone?

“I’m 72 in three months. I could do with £40,000. I don’t blow money away, I’m very careful.”

Though his neighbour eventually agreed to the replacement, problems emerged during construction.

Mr Micallef claimed the new fence encroached onto his property and sought advice from a solicitor.

Speaking to the Mail, the neighbour said: “This matter was resolved through a formal settlement agreement.”

Ealing Council said residents concerned about land disputes should seek legal advice.

A spokeswoman for the local authority said: “Boundary disputes and encroachment are civil matters, and typically end in legal action being taken if mediation doesn’t work.

“In this case, it has resulted in legal proceedings being taken.

“If residents have concerns about disputes, they should seek independent legal advice.”
